Making A Claim For Road Accident Injuries – FAQ

Our personal injury solicitors offer the following answers to common questions about injury claims arising out of traffic accidents;

Q. I’ve been injured in a road accident – am I entitled to compensation?

A. Any injury you sustain as a result of other people’s negligence gives you a potential claim for compensation. This is certainly true for road accident injuries. These can be more straightforward claims, since it’s often easier to prove that the other side was exclusively at fault. If you’re hurt as a result of a car running into the back of you, for instance, it’s obvious that you weren’t to blame for your own injury. Once the other side’s negligence has been proved, accident compensation usually follows.

Q. What’s the first step I should take in making a claim?

A. Once your injuries have been treated, your first step should be to contact a specialist injury lawyer with experience of road accident claims. They will be able to evaluate your case and advise you of the probable outcomes, guiding you through the process and pursuing the claim on your behalf. It’s not impossible to pursue a claim by yourself, but it’s extremely ill-advised – a specialist accident claim solicitor represents your best chance of success, and will make the whole experience much less stressful.

Q. The other side have offered to settle with me directly – should I accept?

A. Not without seeking legal advice first. Offers of direct settlement are usually an attempt to buy you off cheaply, and will almost certainly not be in your best interests. Of course, fair offers are sometimes made too, so get your injury claim solicitor to look at what’s being tabled before making a decision.

Q. How long will it take to settle my claim?

A. There are no hard and fast rules for this, as each claim is different and is settled on its own merits. However, the process is much faster than it used to be. The other side now have just one day to acknowledge your claim and 15 days to admit or deny their liability. This is a considerable tightening up of timescales, when it could take anything up to three months before the other side made a statement about their liability. A faster claim is obviously much less stressful for all concerned, and it’s not unusual for injury compensation claims to now be settled within a couple of months.
